These Terms govern use of this marketing website. The relationship between Hyperfyne and paying clients is governed by a separate signed Service Agreement. In any conflict between these Terms and a signed Service Agreement, the Service Agreement controls.

This site is a marketing and informational site for Hyperfyne’s web design and management subscription services. Pricing, plan descriptions, and feature lists are for general guidance. Nothing on this site constitutes a binding offer or guarantee of availability until Hyperfyne confirms the engagement in writing and a Service Agreement is signed.

Hyperfyne offers monthly subscription plans for website design, hosting, and ongoing management. Key terms that apply to all subscription engagements:

• All plans require a 12-month minimum commitment.
• Billing is monthly via Stripe at the rate shown in the applicable plan at the time of signup.
• Plans auto-renew on a month-to-month basis after the initial 12-month term.
• No setup fees are charged.
• The website design created by Hyperfyne remains the intellectual property of Hyperfyne until and unless a buyout is completed. Clients own their domain name and all content they provide.
• Full cancellation, termination, and refund terms are in the Refund and Cancellation Policy and the signed Service Agreement.

You agree to use this website lawfully and without interfering with its operation.

• Do not attempt unauthorized access to the site, forms, or connected systems.
• Do not scrape, copy, or republish substantial site content without written permission.
• Do not submit false, abusive, or misleading information through the contact form.
• Do not use the site in any way that could damage or overload it or its service providers.

Site content, copy, branding, layout, and design are owned by Hyperfyne or used with permission. You may not reproduce or use them commercially without written permission.

For active clients, the website Hyperfyne builds is licensed for use during the subscription period. The design does not transfer to the client upon cancellation unless a buyout is completed per the Service Agreement terms.

Hyperfyne does not guarantee rankings, traffic, lead volume, conversion rates, sales, or any specific business outcome. Website performance depends on many factors outside of Hyperfyne’s control, including market conditions, client industry, competition, and how the client uses the site.

Hyperfyne may link to demo sites or third-party pages for illustration purposes. Hyperfyne is not responsible for the content, availability, or privacy practices of external sites.

This website is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Hyperfyne disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the fullest extent permitted by law, Hyperfyne will not be liable for indirect, incidental, consequential, special, or punitive damages arising from website use or reliance on public site content. Liability for the subscription service relationship is governed by the signed Service Agreement.

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Disputes related to website use shall be brought in a court of competent jurisdiction in Florida, unless a signed Service Agreement provides otherwise.

Hyperfyne may update these Terms from time to time. The version posted on this site controls as of its posted effective date. Continued use of the site after updates constitutes acceptance.
